Barney, as he is known, received his Bachelor of Arts degree in English from Brigham Young University in 1982. In 1985, he graduated from J. Reuben Clark Law School, where he served as an editor for the Journal of Legal Studies. Barney spent the first eleven years of his legal career as an Air Force Judge Advocate (JAG). He served as a prosecutor, defense counsel, and appellate counsel, and as an advisor on employment law issues. Barney also worked as the chief investigator of medical claims at the Air Force’s largest medical center.
During his tenure with the Air Force Barney was selected as a Special Assistant United States Attorney and was specifically assigned to serve as an investigator in the Program Integrity Division of the Department of Defense Inspector General’s Office. In this capacity Barney investigated general officers and general officer-equivalent civilians, including a high-visibility and sensitive investigation of the Supreme Allied Commander of Europe.
Barney left active duty in 1996 and accepted an offer to serve as an Assistant Attorney General in the Appeals Division at the Utah Attorney General's office where he argued on behalf of the state before the Utah Court of appeals and the Utah Supreme Court. In 2007 Barney retired as a Lieutenant Colonel in the United States Air Force Reserves.
Since leaving public and military service, Barney has enjoyed a successful career in private practice. In addition to his litigation practice, Barney has developed a particular expertise in trademark law and copyright law, employment law, and medical malpractice matters. He is a member of the International Trademark Association (INTA), is a master of the bench in the A. Sherman Christensen American Inn of Court I, and was voted by his peers as one of "Utah's Legal Elite" in business litigation.
